A horrific crash involving a prototype Dark Horse Mustang hitting children watching it at a track in Auburn Hills has led to a lawsuit against Ford, the track operator, a nonprofit organization, and the driver of the car. It’s now a fight which might play out in a courtroom if the parties don’t settle.

The accident happened back in July 2023 with a STEM field trip to the test track. The kids were excited to see the prototype Mustang speed around. But in cellphone video recorded by an adult, the pony car suddenly gets sideways and slides right into the barriers between the people and the speeding vehicle.

Audio from the recording portrays children screaming in horror and pain after the crash. At least one can be heard pleading for help. It’s not an easy thing to listen to.

Two children, an 8-year-old and a 10-year-old, suffered severe injuries to their legs and brains. Both now struggle with getting around, cognition, and memory.

An attorney representing the families of the victims said the Ford employee behind the wheel purposely lost control of the Mustang Dark Horse “to make it exciting” for the kids. But he said the result was a crash which has changed lives.

He also alleges negligence in allowing the children to be so close to the test track as the prototype Dark Horse Mustang was pushed to its limits by the driver. We do know from racing that when you push the envelope it’s likely things will go sideways suddenly, sometimes quite literally.

Many tracks have quite a few restrictions on where spectators can be, let alone what drivers are allowed to do while using the facilities. There’s a reason those restrictions exist, to avoid incidents like this.
