What to Do If Someone Threatens to Sue You Over a Used Car

If you want to make the most money you can when selling your car, you almost always want to sell it yourself. But as frustrating as dealing with Craigslist buyers can be, the fun doesn't necessarily end once the car is gone. In some cases, the buyer will come back expecting you to fix something that went wrong. If you don't, they may threaten to sue.

According to consumer protection attorney and R&T contributor Steve Lehto, you shouldn't let a threat bother you. In his experience, the vast majority of people never actually file a lawsuit. And even if you actually do get sued, the odds are strongly in your favor.

That's because, in most states, private party car sales are all as-is. Unless you're specifically offered a warranty, it's assumed there isn't one. And that makes it difficult for the buyer to win their case. If your ad was honest, you're probably in the clear.

Sure, it's annoying to waste half a day in small claims court, but isn't that better than paying for repairs you're not responsible for?
